Pilot legal notice
This baseline is prepared for Comfort ATL’s private pilot and should be reviewed with Georgia counsel before public launch.
The short version
Comfort helps people discover, save, and plan—not guarantee availability, suitability, or a particular experience.
Owners and Creators must provide accurate information and may receive verified access only after Comfort review.
The current private pilot uses test payments; real charges are not enabled.
Agreement and pilot status
These Terms of Use (“Terms”) are an agreement between you and Comfort ATL (“Comfort,” “we,” “us,” or “our”) governing your access to our local discovery, business, Creator, marketplace, and pilot-feedback features (the “Service”). By accessing or using the Service, you agree to these Terms and our Privacy Policy.
Comfort is currently a private pilot. Features, listings, eligibility, availability, and access may change as we test and improve the Service.
Eligibility and accounts
You must be at least 13 to use customer features. You must be at least 18 or the age of legal majority where you live to claim a business, apply as a Creator, agree to marketplace project terms, make payments, or receive payouts.
Use your own secured account, provide accurate information, maintain the confidentiality of your access, and notify Comfort through the support channel shown in your account if you suspect unauthorized use. You are responsible for activity associated with your account.
Listings, discovery, and Comfort Intelligence
Comfort provides discovery and recommendation support. Listings, operating hours, menus, prices, event details, availability, accessibility, and other business information can change or be incomplete. Confirm important details directly with the business or event provider.
Recommendations and Comfort Intelligence results are not guarantees. You remain responsible for decisions involving dietary needs, allergens, alcohol, transportation, personal safety, reservations, purchases, and whether a place or experience is suitable for you.
Business claims and verification
You may claim or manage a business only if you are authorized to do so. Claimants must provide accurate profile, location, operating-hour, contact, and ownership information and may be asked for supporting evidence. Business claimants and Owners must also accept the current Comfort Owner Agreement.
A Comfort verification badge means the profile completed Comfort’s then-current review. It is not an endorsement, license, health inspection, legal opinion, or guarantee of the business, its products, or its conduct. Comfort may request more information, correct a listing, remove a badge, or restrict access when information is inaccurate or standards are not met.
Creator applications and marketplace standards
Creators must submit authentic identity, portfolio, audience, service, and rate information and accept the current Comfort Creator Agreement. Marketplace access and a Comfort Verified Creator badge activate only after Comfort review and may be suspended or removed if information becomes inaccurate or conduct violates these Terms.
Creators and businesses are responsible for agreeing on scope, price, timing, revisions, delivery, approvals, usage rights, and any other project terms. The accepted proposal and signed project terms control those details. Each party must communicate honestly, deliver what it accepts, and respect intellectual-property and publicity rights.
Creators are responsible for truthful endorsements and clear, prominent disclosure of material connections or paid relationships. Comfort labels paid marketplace work as a “Paid Creator Partnership,” but that label does not replace a Creator’s or business’s disclosure obligations.
Marketplace fees and payments
Unless a project states otherwise before acceptance, Comfort’s marketplace fee is 15% of the accepted Creator project price and the Creator payout is 85%, subject to refunds, disputes, payment-provider fees that are separately disclosed, tax obligations, and agreed adjustments.
Stripe processes marketplace payments and payouts. Its services are governed by Stripe’s terms. Payment release may depend on project completion, dispute status, identity verification, and a valid payout account. Membership cancellations, project refunds, payment holds, and resolution steps are described in the Refund, Cancellation & Dispute Policy.
The current private pilot uses Stripe test mode. No real customer charges or Creator payouts are enabled. Comfort will provide clear notice before a live payment is submitted.
Reviews and other content
You retain ownership of content you submit. You give Comfort a non-exclusive, worldwide, royalty-free license to host, store, reproduce, format, display, and distribute that content as needed to operate, promote, and improve the Service, consistent with your chosen visibility and our Privacy Policy.
Submit only content you have the right to use. Reviews must reflect genuine experiences and may not be deceptive, paid without disclosure, harassing, unlawful, privacy-invasive, or manipulated. Comfort may moderate, reject, label, or remove content and may preserve records needed for safety or disputes.
Communications and optional marketing
Comfort may send service messages needed to operate your account, including safety, security, verification, project, billing, privacy, and support notices. These messages are separate from optional marketing.
Comfort sends promotional emails only after an affirmative, optional choice. Marketing consent is not required to create an account, claim a business, apply as a Creator, or use Comfort. You can change that preference in your account at any time without affecting service messages.
Marketing emails must accurately identify Comfort, use a subject that reflects the message, identify advertising when required, include Comfort’s valid postal address, and provide a clear internet-based way to stop all marketing email. Comfort will not charge for an opt-out or require information beyond the email address, and will honor the request within 10 business days.
External links and transactions
Comfort may link to restaurant, reservation, event, ticketing, map, social-media, or other third-party services. Those providers control their services and transactions. Comfort is not the seller or reservation provider for a transaction completed outside Comfort and is not responsible for a third party’s availability, cancellations, refunds, content, security, or conduct.
Acceptable use
Do not misuse the Service; access another person’s account; scrape or copy the Service at scale; interfere with security or operation; submit malware; impersonate a person or business; manipulate reviews or verification; infringe intellectual-property or privacy rights; use the Service for unlawful discrimination; or engage in fraud, harassment, threats, or illegal conduct.
Comfort materials
The Service, its design, software, branding, editorial material, and Comfort Intelligence systems are owned by Comfort or its licensors and protected by applicable law. These Terms give you a limited, revocable, non-transferable right to use the Service for its intended purpose during the pilot. They do not transfer ownership of Comfort materials.
Suspension, termination, and changes
You may stop using the Service at any time. Comfort may limit, suspend, or end access; remove content; or change or discontinue features to protect users, comply with law, address risk or misuse, or operate the pilot. When practical, we will provide notice and an opportunity to address a correctable issue.
Disclaimers and limits
To the fullest extent permitted by law, the Service is provided “as is” and “as available.” Comfort disclaims implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, current, complete, or that a recommendation, business, Creator, event, or project will meet expectations.
To the fullest extent permitted by law, Comfort will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, goodwill, or opportunities arising from the Service. Some jurisdictions do not allow certain exclusions, so these limits may not apply to you. Nothing in these Terms limits rights or liability that cannot legally be limited.
Governing law, updates, and contact
These Terms are governed by the laws of the State of Georgia and applicable United States law, without regard to conflict-of-law principles. We may update these Terms as the pilot changes. The effective date above identifies the current version, and we will provide additional notice when a change is material.
Questions can be submitted through the support or pilot-feedback channel shown inside your Comfort account.
